Significant Difference between Business and Legal Research Writing; Author’s views and inspiration

For a period of time, observing the different writing approach from the different academic faculties and disciplines inspire the blog author to compare the difference and significance of the different writing disciplines to the unique actual research approach of today.  

 To site as a given example, allow me to use the ASEAN’s young existence in the community of countries around the world.  As we have known that ASEAN community will interact with other group of countries such as EU, NAFTA, et al. a more academic writing requisites are being demanded considering the different approach from the different writing disciplines.  This write-up will only differentiate the highlights of Business and Legal Research Writing.

Terms to be considered:

1. Logic and Reasoning- To any research writing technique; logic, philosophy, and reasoning is the fundamental tool to any given case argument.   Without logic, a legal researcher or an academic researcher cannot play around the four corners of the case. The beauty of logic is, it can change the ideas of any given case to the fullest understanding of human intelligence.  As you play along with logic and philosophy human understanding to practical world case scenarios is more understandable and can find a more generally accepted conclusions. As we narrow down to Academic and Legal research writing. Legal research are more dependent in playing along with logic as to the nature of the given faculty that legal reasoning and analysis are relying its evidence either from previous docket or constitutional laws given by the land. While in the contrary, business research writing follows the conclusive arguments according to the concrete statistical results and financial data given annually by the company’s annual stock exchange report or previous research journals analyzed through hypothesizing and giving a conclusive statistical measurement. Some will state the notion that mathematics will give the concrete and fair measurement but logic on the other hand can also bend the ego and super-ego of a given human community, that it will dramatically change the conclusive decision of the jury.

2. Primary Sources of evidence- sources of research evidence differs from the different academic faculties given. As to business and legal research writing, sources of evidence are an important part in proving that your notion or plea is conclusively true.  Considering legal writing, Constitutions, Statutes, Courts Rules, docket, and Administrative laws are always the refuge for conclusive defense.  On the contrary, business research (as what I mentioned above) depends on research and business financial data in giving conclusions.  Though these two different faculties of sources are different in nature, but to some event cross journal referencing can sometimes be useful to break the monotonous argument that may usually lead to a unique judgment and business research knowledge.

3.  Format- The intelligence and fanciness of the writer’s skill in composing either legal or business writing determines the fundamental skills learned by the business or legal writing practitioner.  Writing in different disciplines requires constant practice and patience to acquire the subconscious habit of “speaking through your hands”.

Finally, my inspiration of exploring the different academic style of writing brought my memories back to my national hero José Protacio Rizal Mercado y Alonso Realonda or what we commonly known as Dr. Jose Rizal.  His writings liberated the Philippines using the skills in professional writing.  To give some memorable writing piece of Dr. Jose Rizal, allow me to quote his famous writing in Spanish language in titled "Mi Último Adiós"

"Mi Último Adiós"

¡Adiós, Patria adorada, región del sol querida,

Perla del mar de oriente, nuestro perdido Edén!

A darte voy alegre la triste mustia vida,

Y fuera más brillante, más fresca, más florida,

También por ti la diera, la diera por tu bien.

En campos de batalla, luchando con delirio,

Otros te dan sus vidas sin dudas, sin pesar;

El sitio nada importa, ciprés, laurel o lirio,

Cadalso o campo abierto, combate o cruel martirio,

Lo mismo es si lo piden la patria y el hogar.
