Reading and skimming some International Business Case
materials related to International Business, I was convinced to open one of my
book collections regarding Legal Writing and Research. I was able to acquire this text knowing that some
parts of the International Business cases are related to International
Law.
As such, I need to have the
fundamental knowledge of legal research and writing format. What challenges me
the most is not the syntax formats but rather the use and order of reasoning
analysis. Comparing to other research
writing discipline, legal writing intensely use and depend its writing
presentation from the logical order opinions from the subject of the case
presented.
BASIC APPROACHES TO LEGAL RESEARCH:
1 Overview approach- derives to the gathering of background
information from secondary sources like law journals available both online and
offline. Specific law journal gathering are
advised in cases that national legal procedures will affect the case premise
presentation.
Your background readings
must reflect to the actual law being practiced where your case problem is
located. Some International companies choose
to hire local or domestic lawyers to represent their companies locally.
2 Topic Approach- considers
the specific and general topics and legal terms required to be used in the
legal research process. Some specific
topics and terms being used of a given country will have a background from the
legal pattern and standard of the country.
Moreover, a country’s legal standard may sometimes patterned and revised
from other countries were the government system is being configured. To illustrate, some countries in Asia and
ASEAN are based either from US or British legal system knowing that some
countries in Asia and ASEAN are colonized either US or British government
system.
3 Known primary source approach- considers the actual
information of the case. This case
primary information is from the business and financial reports incurred by the
business organization involved in the case dispute.
The primary and actual case resources must
reflect logically to the secondary resource in order to find solid reference in
terms of asking a plea or rationalizing the case argument. Paralegal researchers are more careful in
gathering primary information for legal evidences from the business
establishments where the organization is making business transactions.
But at present time, legal research teams are using any
means of technological gadgets to acquire the desired legal information for the
case evidence.
Good legal writing presentation is necessary to present the accurate
argument showed in written presentation.
The actual debate and verbal presentation is only the reflection from
the written legal plea and argument submitted to the court of law.
