Business legal bargain is believed to be in a system hierarchically in order according to the power that dominates the   business legal dispute situation.  Usually a third party is used to mediate the first and second party. 

Managing the dispute in the part of the third party, one must know the real knowledge background of the situation before assuming the third party role. Hence, third party experts that will mediate the negotiation must have the consent from both first and second party.
