As a business negotiator and a legal practitioner at the same
time, one must know and practice the ethical standards of business negotiation
Model Rule 4.1 which regulates the ethics of lawyers,
provides that an attorney “shall not knowingly make a false statement of
material fact or law to a third person”.
1 Affirmative Misrepresentations
2 Partially True Statement
3 Impermissible Omissions
Some misrepresentations in negotiation are deemed illegal towards
the client or customer when the receiver of the goods or service has the right
to know the exact details of the product or service rendered. Further obligatory assistance must be given
not only to aid the customer’s product usage but also to assist the damages
being incurred.
